Terms & Conditions
Notice of Loss/Damage
No liability for loss or damage will be accepted by the
carrier unless verbal notice has been given to the carriers
within 24 hours after such loss or damage has become known
and written notice is received within 7 days after the
shipment is accepted by the carrier. Shipments must be
inspected at the time of pick up and delivery and any damage
must be indicated on the waybill with the driver as a
witness.
Critical Path cannot take responsibility for shipments that
are not packaged, or poorly packaged, allowing for the
possibility of damage. Where the location of a delivery or
pick up does not allow for manoeuvring oversized, awkward or
extremely fragile shipments, Critical Path cannot take
responsibility for damage caused to or by this environment.
Critical Path cannot be responsible for shipments that
require special shipping areas where none are provided.
Declared Value
1. Carrier's liability for any loss, damage or injury to a
shipmen
t shall not exceed the lesser of $1.50/lb. or $250.00.
2. Additional insurance can be purchased at a rate of $2.00
per $100.00. Value must be indicated upon ordering the
shipment.
3. If additional insurance is not purchased by the client at
time of the order placement, number 1. above will take
effect.
Limits of Liability
Carrier shall not be liable for any loss, damage,
destruction or unreasonable delays arising from the
following causes: Acts of God, Strikes, Authority of Law,
Defect or inherent Vice in the goods shipped, Act or Default
of the shipper or owner of the goods, Nuclear Reaction,
Radiation or Radioactive Contamination.
Delay
Unless the parties agree otherwise in writing, the carrier
shall not be liable for any special consequential or other
damages caused by mere delay in the delivery of a shipment,
regardless of the cause of such delay.
